REEF RENTALS TERMS AND CONDITIONS
Reef Rentals, LLC “Lessor” agrees to rent to lessee (name on the first page) and lessee agrees to rent from Lessor, the Property described in the first page, on the terms and conditions set forth berein.
OFFICE HOURS: Monday – Friday 9:00 am to 5:00 pm
We are available after-hours and over holidays for rental emergencies, please just leave a message on our main number 305-367-4280 as it is checked periodically.
DISCLOSURE: Lessor is the Management Company of the Property. All properties represented by the Management Company are furnished with the renter in mind and may have some owner personal items. Lessor represents the owner of the property in a client/agency relationship. The terms lessee, renter(s), guest(s) and tenants(s) are used herein interchangeably and are defined as the principal party renting a vacation rental property and those accompanying the principal party. Renter must be either a member or sponsored by the Lessor, Ocean Reef Club, a CLS Member or a member of Ocean Reef Club. Call us to see how you may qualify.
DEPOSIT AND PAYMENT POLICY:
A deposit equal to 50% of the reservation is due within 7 days of reservation and final payment is due 30 days prior to arrival. If the reservation is within 30 days of arrival full payment of the rent is due at time of reservation. This “Rental Agreement” which includes all of the terms and conditions, shall be binding upon all parties hereto, their respective heirs, assigns, personal representatives and successors.
ADMINISTRATION FEE/DAMAGE INSURANCE: This fee pays for Wi-fi or cable internet access, damage insurance, check processing fees and are non refundable.
CLEANING FEE: All properties require departure-cleaning services. Upon expiration of the rental period, Lessee will vacate the rental unit and said unit shall be in as good order as was originally presented, reasonable use and natural wear excepted. For a rental reservation of 2-6 days, the tenant is required to pay a departure/final cleaning. For weekly rentals or greater, guests are required to a weekly cleaning charge until time of departure. Guests are responsible for leaving the property on time and in good order before arrival for the next guests. Guest shall leave all doors and windows locked and make sure the air conditioning unit on 72 degrees and humidistat are left on upon checkout.
REFUND POLICY: Should the owner of any property elect to remove their property from our rental program, the lessee will not be able to occupy such unit, and the renter shall not hold the lessor or the owner responsible. In such an instance, the lessee will be relocated to comparable accommodations determined by the lessor. If comparable accommodations are not available, the lessee will receive an appropriate refund.
Lessor is not responsible for events beyond its control, e.g. inclement weather, strikes, changing governmental or club regulations. Optional travel insurance may be purchased at the time of making initial reservation payment. Travel insurance generally covers the event of a medical emergency or weather hindrances that you may receive a full refund, less the administration fee. Please ask for additional information on the travel insurance rates.
VACATION RENTAL INSURANCE
Vacation rental insurance is a separate, added component of the rental package, at renter’s election. The cost of this is insurance is 7% of the rental amount plus taxes. Vacation rental insurance provides added financial protection against lost trip payments and fees, which occur as trip cancellation, trip interruption, travel delay, emergency medical transportation and other losses. Policy benefits, along with applicable definitions and terms and conditions of coverage, are fully described in the insurance policy. Prior to travel, it is the tenant’s responsibility to read the policy and have their questions answered. This insurance is provided by Travel Guard, not the Lessor. TheLessor, is licensed to sell insurance but is not responsible for the provider of the insurance and has no liability or responsibility for such insurance.
CANCELLATION POLICY– written notice of cancellation must be received by the Lessor, sixty days (60) prior to scheduled arrival (ninety (90) days for specified holidays) to avoid forfeiture of the entire rental amount. If the property is fully re-rented an appropriate refund will be issued less a 20% cancellation charge. If partially re-rented a prorated refund will be issued less a 20% cancellation charge. In the event two or more parties jointly lease a property and one party cancels, the remaining party/parties shall be obligated for the rent as stipulated.
All notice of cancellation must be in writing. Emails are permitted as long as they are acknowledges by the management company.
CHECK-IN/CHECK-OUT: Check-in time is 4:00PM, and checkout time is 12:00 NOON *Unless otherwise arranged in advance.
RESERVATIONS AND ACCESS: As the Renter, you are renting the unit from Lessor, which is Reef Rentals, LLC acting as the Management Company for the owners of the property. The Ocean Reef Club has absolutely no responsibility for the Lessee’s reservations, occupancy, repair or for the delivery of keys to this unit, and the Front Desk of the Hotel will not have a key for the Lessee unless otherwise directed. If you are a sponsored guest, the Club’s services and amenities are available to you during your rental period only.
THE FOLLOWING APPLIES TO NON-MEMBERS ONLY: A current member in good standing must sponsor non-members at the Ocean Reef Club. When arriving at the Front Gate simply state your name and show identification to the Public Safety officer and they will direct you to the front desk located at the hotel. Your sponsor will have requested the Club to issue you an Ocean Reef Club Guest (credit) Card, as the Club facilities do not accept cash. Please give the individual at the Front Desk a personal credit card on which to apply your actual charges. You may then proceed to your Vacation Rental. An accounting of all charges will be available upon your check out. According to new Ocean Reef Club policy, all sponsored guests are required to pay a daily $11.50 plus tax “Club Facility Usage Fee” (regardless if the sponsored guest rents directly through the Club or a private agent). All guest charges including the daily club charge are generally charged to the guest card directly. Lessee will be fully responsible to reimburse Lessor for any daily usage fees charged against the rental property plus any applicable taxes. In the event the daily or any other charges are charged to the property, the renter will be responsible to reimburse them. All renters are fully responsible for all charges such as meals / cart rentals / telephone charges etc. incurred during their stay. Club charges may change from time to time.
OCEAN REEF REGULATIONS: During the period of occupancy, Lessee agrees to comply with all the rules and regulations of the Ocean Reef Club including member dress code and to otherwise occupy the rental unit in a safe and proper manner. Lessee shall not use or permit the use of the rental unit for any illegal, immoral or improper purposes, not to make nor permit any disturbance, noise or annoyance whatsoever detrimental to the premises or to the comfort and peace of any of the inhabitants of said building or its neighbors, and particularly said Lessee agrees that under no circumstances will they allow or permit their child or children to play in the halls, lobby, porches, stairways or parking lots of said building or in any other way to aggravate the tenants of the building. Reef Rentals does hereby reserve the right to terminate this lease at any time violations are found to exist. Be advised that the respective Condominium Associations at the Ocean Reef Club maintain individual rules and regulations regarding the number of people in a specific unit as well as docking regulations and further that dockage is NOT regularly included with the rental of said property unless otherwise agreed upon. It is suggested that you read the specific condominium rules for everyone’s enjoyment.
KEYS will be on the counter at property upon arrival and may be left in the unit on the counter on the day of departure. Any keys not turned in at departure are subject to $25.00 charge.
ACCOMMODATIONS: Accommodations range from private homes, condominiums, garden homes and docks. All properties are privately owned and individually furnished with basic items such as televisions, appliances, glassware, cookware, flatware, dishes, and initial toiletries, as well as other small appliances, patio furniture, iron and ironing board, radio, etc. Additional toiletries and food may be purchased at the local Ocean Reef grocery (Gardeners Market).
SUPPLIES: The rental property will have fresh linens, bed pillows, towels and washcloths. For additional linens please contact our office.
SMOKING PROHIBITED: All properties managed by Reef Rentals are NON-SMOKING properties. Smoking is NOT permitted in any of our rental properties. There will be a $300 damage charge plus additional charges to remove the smell should this be violated.
GATHERINGS: Our properties are located in residential areas and are rented for personal vacation use only. Loud noises of any kind are prohibited. Parties and other large gatherings are not allowed, unless otherwise permitted by the Lessor. Violators are subject to forfeiture of their rental fees, and eviction.
MAXIMUM OCCUPANCY: Each property has a specific maximum occupancy. Take note of the maximum number of guests allowed in the homes and condos before making your reservation. This policy is strictly enforced.
PET POLICY: NO PETS ARE PERMITTED in any accommodation without prior written authorization. Some small pets are allowed in specific properties upon prior arrangements with a pet deposit of $500.00 and/or pet cleaning fee of $150. There can be no noise from pets that may disturb the neighbors.
TELEPHONE USE: Please use a telephone credit card for all long distance calls. Please keep in mind that any area North of Ocean Reef and South of Plantation Key proper is considered a toll call and will require a phone card. The long distance is blocked on all telephones unless prior arrangements have been made with Reef Rentals. You will have unlimited local calling within Ocean Reef and the surrounding areas. Most cell phones work for long distance from the Reef. The Ocean Reef’s operator number is 305-367-2611and can connect you to nearly all sites on The Reef.
REPAIRS AND MAINTENANCE: The tenant agrees to permit the Lessor at any reasonable time to enter said premises or any part thereof for the purpose of making repairs thereto. In the Event the property subject to this lease is not immediately repairable then Lessor will endeavor to find a similar
replacement property. If there are any problems with your rental unit or if you have any questions please call Reef Rentals immediately at (305) 367–4280, so we can take care of the problem or answer any questions you may have.
CREDIT CARD AUTHORIZATION: Renter agrees to give the Lessor a credit card to hold and subject to inspection of the rental property after departure authorizes Lessor, to charge the credit card for the cost of repairs, replacement, services, telephone charges or extra cleaning for all damage, breakage and/or loss incurred during his/her stay. In the event of damage to the premises, its equipment, furniture, or carpeting, Lessee shall be responsible for damage costs exceeding the security deposit, including collection costs and attorney’s fees should these be incurred. Documentation detailing damages and charges will be provided to the guest.
INDEMNIFICATION: Lessee agrees to indemnify and hold harmless the Lessor, the owner of this specific rental unit, as well as the Ocean Reef Club, Lessor, and all of their officers, directors, employees, agents and affiliates from any and all claims, costs, liabilities and damages of whatsoever nature arising out of the Lessee’s use or occupancy of the property at the Lessee’s activities at the Ocean Reef Club which may occur during the occupancy of the rental unit by the Lessee or their guests. The Lessee agrees that Lessor shall not be liable to Lessee, Lessee’s guests, invitees or any other person for any injury, loss or damage to any person or property on or about the rental premises. Renter shall hold Reef Rentals, a division of Fairway Property Managers, Inc. harmless and indemnified from and against all loss or damage occasioned by use, misuses or abuse of any part of or fixture on the premises, surrounding areas and from or against any omission, neglect, or default of the Renter, his/her guests or invitees.
MISCELLANEOUS: The terms and conditions set forth in this agreement and in the Rental Confirmation constitute the entire understanding reached between the Lessee and Lessor pertaining to the rental of the property. No terms and conditions stated in this agreement may be modified, unless separately written and signed by all parties. The terms, Lessor, Management Company and Manager refer to Reef Rentals, LLC.
